Terms of sale

Please read these terms carefully before placing your order. We recommend printing or saving a copy of these terms, along with your order confirmation, for future reference.

1. Formation of the contract

1.1 These terms of sale (“Terms”) set out the conditions under which Side supplies goods ordered directly from our online store.

1.2 Please read these Terms carefully before placing an order. By placing an order with Side, you agree to be bound by them. If you do not agree, you should not proceed with your purchase.

1.3 These Terms, and any contract between us, are available in English only.

1.4 A contract is formed only once Side has accepted your order and received full payment. We are under no obligation to accept your order.

1.5 You must be at least 18 years old to place an order. By placing an order, you confirm that you meet this requirement. If you are purchasing on behalf of a business, you confirm that you are authorised to bind the business to these Terms.

1.6 Side reserves the right to update these Terms at any time. The Terms in place at the time of your order will apply. Please review them before each purchase.

2. Availability, descriptions, pricing

2.1 All goods are subject to availability. If items are out of stock when your order is received, we will inform you as soon as possible.

2.2 Prices are those listed at the time of purchase, in GBP (£), and exclude delivery charges. Delivery costs will be confirmed at checkout before payment is made.

2.3 While we aim for accuracy, pricing errors may occasionally occur. If a mistake is identified before dispatch, we will contact you to confirm your order at the correct price or allow you to cancel.

2.4 If you are ordering goods for delivery outside the UK, you are responsible for compliance with any local import laws and for any duties or taxes that may apply.

3. Payment

3.1 Payment must be made through the payment system provided at side-gallery.com.

3.2 All deliveries are subject to successful payment authorisation.

4. Delivery and risk

4.1 Orders will be delivered to the address provided at checkout.

4.2 If no one is available to receive the delivery, the courier may leave a note with options to rearrange delivery or collect from a designated location.

4.3 A signature may be required for select deliveries. This signature confirms receipt of the order.

4.4 Ownership and risk in the goods pass to you upon delivery.

5. Right to return (for consumers)

5.1 You must return items at your own expense in their original condition and packaging. We are not liable for any returned items which arrive damaged, or are lost by your chosen courier/delivery agent.

5.2 Refunds will be issued within 30 days of receiving your returned item, provided the goods are received in re-saleable condition. Damaged or altered goods will not be refunded.

5.3 If you fail to return the goods as required, we reserve the right to withhold the refund or charge you for the cost of recovery.

5.4 Custom-made or personalised goods, including framed works outside our standard specifications or signed editions, are non-refundable unless otherwise agreed in writing.

6. No right of resale

6.1 If you are a consumer, goods are sold for personal use only and not for resale.

6.2 If you are a business, goods are sold for internal use only, and not for resale, unless explicitly agreed in writing.

6.3 Exceptions to this clause apply only under a signed and dated Consignment Agreement, and only for the agreed period.

7. Public display of works

You may not publicly exhibit or authorise the display of any artwork or edition purchased from Side in a commercial setting without prior written consent from Side. Side does not hold copyright for images, public display may also require written permission from copyright holders.

8. Intellectual property

Purchase of any item does not grant you copyright or other intellectual property rights. Artists retain moral and intellectual rights, including the right to be identified as the author.

9. Liability

9.1 Nothing in these Terms limits our liability for death or personal injury caused by negligence, fraud, breach of statutory rights under the Sale of Goods Act 1979 or the Consumer Protection Act 1987.

9.2 Subject to 9.1:

  • We exclude all implied warranties to the fullest extent permitted by law;

  • We will not be liable for business losses, loss of profit, or indirect/consequential damage.

9.3 We are not responsible for defects arising from wear and tear, misuse, or damage after delivery. Please contact us promptly if you believe an item is defective.

9.4 We are not liable for delays or failure to perform our obligations due to circumstances beyond our reasonable control.

9.5 These Terms do not affect your statutory rights as a consumer. For advice, you may contact Citizens Advice or Trading Standards.

10. Marketing communications

We may contact you about new works, exhibitions, and publications. You can unsubscribe from these communications at any time.
